MyLawnBiz Terms of Service
Effective date: {EFFECTIVE_DATE} Last updated: {EFFECTIVE_DATE}
These Terms of Service ("Terms") are an agreement between you and {ENTITY_NAME} ("MyLawnBiz," "we," "us"), a {ENTITY_TYPE} based in Georgia, USA. They govern your use of the MyLawnBiz platform at mylawnbiz.com, including your tenant website, CRM, payment tools, and AI features (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
We wrote these Terms to be readable. Where something has a specific legal meaning, we've tried to say it plainly too.
1. Who we are and what the Service is
MyLawnBiz is a platform for lawn care and outdoor service businesses. When you sign up, you get:
- A public website on your own subdomain (e.g.,
yourbusiness.mylawnbiz.com), with custom domain support on paid plans - A CRM to manage leads, customers, estimates, proposals, jobs, and invoices
- Payment processing for your customers, powered by Stripe
- AI-assisted features, such as property photo analysis
In these Terms, "you" or "Tenant" means the business account holder. "Your Customers" means the homeowners and clients whose information you put into the Service.
2. Your account
- You must be at least 18 and able to form a binding contract to use the Service.
- You must provide accurate account information and keep it current.
- You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away at {SUPPORT_EMAIL} if you suspect unauthorized access.
- One person or business per account. You may not share, sell, or transfer your account without our written consent.
3. Plans, billing, and fees
3.1 Plans
We currently offer three plans:
| Free | Growth | Pro | |
|---|---|---|---|
| Price | $0 | $49/mo or $490/yr | $99/mo or $990/yr |
| Paying customers | Up to 5 | Up to 50 | Unlimited |
| AI analyses per month | ~10 | ~100 | Unlimited |
| Website | MyLawnBiz subdomain | Custom domain | Custom domain |
| "Powered by MyLawnBiz" branding | Yes | Removed | Removed |
| Payment platform fee (see 3.3) | 1.5% | 1% | 0.75% |
Annual billing gives you two months free compared to monthly. Plan limits count paying customers — leads, estimates, and proposals are unlimited on every plan.
When you hit a plan limit (for example, converting a 6th paying customer on the Free plan, or running out of monthly AI analyses), the action is blocked and you'll see an upgrade prompt. Nothing is deleted and nothing fails silently — you can upgrade at that moment or wait.
3.2 Subscription billing
- Paid subscriptions are billed in advance (monthly or annually) through Stripe. We do not see or store your card number; Stripe handles that.
- Subscriptions renew automatically until you cancel.
- Canceling doesn't delete your account — it downgrades you to the Free plan at the end of your current billing period. Your data stays intact. If your data exceeds Free-plan limits after a downgrade (for example, more than 5 paying customers), existing records are kept and remain accessible, but limit-gated actions are blocked until you're back under the cap or upgrade again.
- Fees already paid are non-refundable except where the law requires otherwise, or where we choose to issue a refund at our discretion.
3.3 Payment platform fee (Stripe Connect)
When you charge Your Customers through the Service, payments are processed via Stripe Connect. In addition to Stripe's own processing fees, MyLawnBiz collects a platform application fee on each transaction: 1.5% on Free, 1% on Growth, and 0.75% on Pro. This fee is deducted automatically before funds settle to your Stripe account. Current fee rates are shown in the Service; we'll notify you before any fee rate change takes effect.
You are responsible for complying with Stripe's Connected Account Agreement and Stripe's Services Agreement, and for the accuracy of charges you create for Your Customers.
3.4 Price changes and grandfathering
We may change plan prices over time. When we raise prices, existing paid subscribers are grandfathered at their current price for as long as they keep their subscription active without interruption — price increases apply to new signups and to accounts that lapse and re-subscribe. If we ever need to change the price of an existing active subscription, we'll give you at least 30 days' notice, and you can cancel before the change takes effect.
4. Your data is yours
- You own your business data and Your Customers' data that you put into the Service — customer records, photos, estimates, invoices, notes, all of it. We claim no ownership of it.
- You grant us a limited license to host, process, display, and transmit that data solely to operate and improve the Service for you (for example: storing photos, running an AI analysis you requested, sending an invoice email you triggered).
- Export: you can request a full export of your data at any time by emailing {SUPPORT_EMAIL}, and we'll provide it in a common machine-readable format within a reasonable time (typically 30 days or less).
- We don't sell your data or Your Customers' data. Ever.
5. Your Customers' data — roles and responsibilities
Under data protection laws, you are the "controller" of Your Customers' personal data, and MyLawnBiz is your "processor." In plain terms:
- You decide what customer information to collect and how to use it. We only process it on your behalf, following your instructions as expressed through your use of the Service.
- You are responsible for having a lawful basis to collect and use Your Customers' data, including any notice or consent your customers are owed (for example, before uploading photos of their property or sending them messages).
- We will: process Your Customers' data only to provide the Service; keep it confidential; use subprocessors only as disclosed in our Privacy Policy; apply reasonable security measures; assist you with reasonable data-subject requests (access, deletion); and delete or return the data when your account is deleted.
- If you need a formal signed Data Processing Agreement, contact {SUPPORT_EMAIL}.
6. AI features
Some features use artificial intelligence — for example, analyzing photos of a property to describe lawn conditions, or processing business text you provide.
- What happens: when you use an AI feature, the relevant content (such as uploaded property photos and related text) is sent to Anthropic, our AI provider, which processes it with the Claude model and returns results to the Service.
- Not used for training: under Anthropic's commercial terms, content sent through the API is not used to train Anthropic's models.
- AI output can be wrong. AI analyses are suggestions to help you work faster — not professional agronomy, horticulture, legal, or pricing advice. Review AI output before relying on it or sending it to a customer. You're responsible for what you deliver to Your Customers.
- AI usage is metered per plan (see 3.1).
7. Acceptable use
Use the Service for running a legitimate service business. You may not:
- Break the law, or use the Service to help anyone else break the law
- Upload content you don't have the right to use, or that infringes anyone's intellectual property or privacy rights
- Upload photos of people or property collected without appropriate permission
- Send spam or unsolicited bulk messages through the Service
- Process payments for anything other than your genuine services, or use the payment tools for fraud, money laundering, or any activity prohibited by Stripe
- Attempt to probe, breach, overload, scrape, or reverse-engineer the Service, or access other tenants' data
- Resell or white-label the Service itself without our written agreement
We may suspend or remove content or accounts that violate this section. Where practical, we'll warn you first.
8. Service availability
We run the Service with reasonable skill and care, and we work to keep it available and fast. However, the Service is provided "as is," without an uptime guarantee or SLA. Downtime happens — maintenance, upgrades, third-party outages (hosting, Stripe, Anthropic), and things we didn't see coming. We'll do our best to communicate about significant disruptions.
We may change, add, or retire features over time. If we materially reduce the core Service you're paying for, you can cancel and we'll refund the unused portion of any prepaid period.
9. Termination
- You can cancel your subscription (downgrades to Free — see 3.2) or delete your account entirely at any time from your account settings or by emailing {SUPPORT_EMAIL}.
- We may suspend or terminate your account if you materially violate these Terms, if your use creates legal or security risk, or if required by law. For non-emergency issues we'll give you notice and a chance to fix the problem first.
- If we discontinue the Service entirely, we'll give you at least 60 days' notice and a way to export your data.
- On account deletion, we'll delete your data per the retention schedule in our Privacy Policy. Export your data before deleting your account — we can't guarantee recovery afterward.
10. Disclaimers and limitation of liability
Plain version first: we're a small company providing software tools. We're not responsible for how your business performs, for disputes with your customers, or for losses beyond what you've actually paid us.
- Disclaimer: except as expressly stated in these Terms, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Liability cap: to the maximum extent permitted by law, MyLawnBiz's total liability for all claims arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (for Free-plan users, $50).
- Excluded damages: neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data, even if advised of the possibility.
- Nothing in these Terms limits liability that can't legally be limited (for example, liability for fraud or willful misconduct).
- Your customers are your customers. We're not a party to agreements between you and Your Customers, and disputes about your services, pricing, or workmanship are between you and them.
11. Indemnity
You agree to defend and hold us harmless from third-party claims arising from your content, your violation of these Terms, your violation of law, or your dealings with Your Customers — to the extent the claim isn't caused by our own breach of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. For material changes, we'll notify you (email or in-app) at least 30 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms; if you don't, cancel before the effective date.
13. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Georgia, and both parties consent to that venue. Before filing anything, please email {SUPPORT_EMAIL} — most problems can be fixed with a conversation.
14. Miscellany
- These Terms, plus the Privacy Policy and any plan-specific terms shown at purchase, are the entire agreement between us regarding the Service.
- If a court finds part of these Terms unenforceable, the rest stays in effect.
- Our failure to enforce a provision isn't a waiver of it.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the business (your data protections travel with the assignment).
